By accessing the website at www.omnistl.com (the "Site"), syncing your Patreon account, or purchasing individual digital licenses, you ("User" or "Subscriber") agree to be bound by these Terms and Conditions ("Terms") and all applicable federal and international laws.

2. SERVICE MODELS AND ACCESS
OMNI STL provides a digital fulfillment service for artistic 3D sculptures. Access is provided through two primary methods:

• Patreon Subscription Benefits: Access to the digital library is granted via a technical webhook integration with Patreon. You must maintain an active, paid membership tier on our Patreon page to retain access to files on this Site.
• Individual Digital Licenses: Users may acquire individual limited-use licenses for specific files without a subscription. These transactions are typically processed via fulfillment agents such as Gumroad.
• Access Only: Your payment provides a limited, non-exclusive, non-transferable license to access digital data. It does not transfer legal ownership of any digital file.

3. DIGITAL DELIVERY AND DOWNLOADS
To ensure accessibility and service reliability, OMNI STL digital files may be delivered through multiple channels:

• On-Site Downloads: Authorized Users may download digital assets directly through their account dashboard on this Site.
• Third-Party Fulfillment (Gumroad): At our discretion, certain files or licenses may be delivered via Gumroad. In such cases, the file will be hosted in your Gumroad Library for ongoing access according to Gumroad’s standard terms.
• Technical Requirements: Users are responsible for maintaining the necessary hardware (such as 3D printers) and software required to utilize the provided digital assets.

4. INTELLECTUAL PROPERTY AND AFFILIATION DISCLAIMER
OMNI STL is an independent, fan-driven platform. We are NOT affiliated with, authorized by, sponsored by, or endorsed by any other third-party intellectual property holders.

• Artistic Interpretations: All 3D models available on this site are original, human-made works of fan art. They are transformative "inspired-by" tributes and represent artistic reinterpretations of popular culture characters.
• Ownership Acknowledgment: All trademarked characters, names, and logos referenced on the Site remain the sole property of their respective copyright and trademark holders. OMNI STL claims no ownership over third-party intellectual property and provides these models for personal hobbyist engagement under the principles of transformative Fair Use.
• Original Geometry: OMNI STL retains the copyright to the specific digital geometry and sculpt created by our artists.

5. LIMITED PERSONAL USE LICENSE
All digital files (STL, OBJ, etc.) provided by OMNI STL are subject to a Personal, Non-Commercial, and Non-Transferable License:

• Prohibited Digital Distribution: You may NOT sell, share, rent, or redistribute the digital STL files or any part of the digital data.
• Physical Print Restrictions: You are authorized to print the models for your own personal enjoyment or as one-off gifts. You may NOT mass-produce, manufacture, or sell physical prints of these models. Any commercial sale of physical prints is strictly prohibited and is done at the User's own legal risk.
• Merchant Exceptions: Commercial rights are only granted if the User holds a specific and active "Merchant License" explicitly issued by OMNI STL for original (non–fan-art) designs.

6. THIRD-PARTY PLATFORM DEPENDENCY
OMNI STL utilizes third-party platforms for billing, payment processing, and external delivery.

• No Liability for Outages: We are not responsible for technical failures, account suspensions, or data issues occurring on Patreon or Gumroad.
• Billing Disputes: All financial transactions are governed by the Terms of Use of the respective payment platform (Patreon or Gumroad). OMNI STL does not store or process your credit card information.

7. REFUND POLICY
Due to the nature of digital goods, all subscription payments and individual file sales are final and non-refundable once the digital content has been accessed or downloaded.

8. LIMITATION OF LIABILITY AND INDEMNIFICATION

• User Indemnity: You agree to indemnify and hold OMNI STL harmless from any legal claims, damages, or costs (including attorney’s fees) arising from your unauthorized commercial use of the digital files or your violation of these Terms.
• Liability Cap: OMNI STL’s total financial liability for any claim shall not exceed the total amount paid by the User to the platform in the twelve (12) months preceding the claim.
